What is Proposition 65?

Proposition 65 (commonly called P65) is a California law that requires the state to maintain and update a list of chemicals known to cause cancer, birth defects, or other reproductive harm. Businesses must provide a clear warning before exposing anyone to these chemicals. The law has been in effect since 1987 and is one of the strictest consumer protection laws in the United States regarding chemical exposure.

When is the warning required?

A P65 warning must be displayed when a product contains any of the chemicals on the official list and may expose consumers to those chemicals. Common products include:
  • Dietary supplements and vitamins
  • Alcoholic beverages
  • Furniture and wood products
  • Cosmetics and personal care items
  • Vehicle exhaust systems
  • Pesticides and garden chemicals
The warning requirement applies to products sold in California and to those shipped into California from other states.

Warnings must be clear and reasonably prominent to ensure consumers see them.
